General Terms of Use and Data Privacy Protection

1. Scope

Any use of this website provided by Rosenberg Ventilatoren GmbH (Rosenberg), "Rosenberg website", is subject to these terms of use.

2. Services

This Rosenberg website contains specific information and software, as well as - as the case may be - related documentation, for viewing or downloading. Rosenberg may stop the operation of the Rosenberg website in full or in part at any time. Due to the nature of the internet and computer systems, Rosenberg cannot accept any liability for the continuous availability of the Rosenberg website.

3. Registration

Some pages of the Rosenberg website may be password protected. In the interest of safety and security, only registered Users may access said pages. Rosenberg reserves the right to deny registration to any User. Rosenberg particularly reserves the right to determine certain sites, which were previously freely accessible, subject to registration. Rosenberg is entitled, at any time and without obligation to give reasons, to deny the User the right to access the password-protected area by blocking its user data, in particular if the user uses false data for the purpose of registration or violates these terms of use.

4. Rights of Use to Information, Software and Documentation

The use of any information, software and documentation made available on or via the Rosenberg website is subject to these terms of use or, in case of updating information, software or documentation, subject to the applicable license terms previously agreed to with Rosenberg. Separately agreed to license terms, for example software downloads, shall prevail over these terms of use. Rosenberg grants user a non-exclusive and non-transferable license, which may not be sublicensed, to use the information, software and documentation made available to the user on or via the Rosenberg website to the extent agreed, or in the event of no such agreement to the extent of the purpose intended by Rosenberg in making same available. Information, software and documen-tation may not be distributed by the user to any third party at any time nor may it be rented or in any other way made available. Unless such is allowed by mandatory law, the user shall not modify the software or documentation nor shall it disassemble, rever-se engineer or decompile the software or separate any part thereof. The User may make one backup copy of the software where necessary to secure further use in accor-dance with these terms of use. The information, software and documentation are pro-tected by copyright laws as well as international copyright treaties as well as other laws and conventions related to intellectual property. The User shall observe such laws and in particular shall not modify, conceal or remove any alphanumeric code, marks or copyright notices neither from the information nor from the software or documentation, or any copies thereof. §§ 69a et seq. of the German Copyright Law shall not be affected hereby.

5. Intellectual Property

Notwithstanding the particular provisions in § 4 of these terms of use, information, brand names and other contents of the Rosenberg website may not be changed, copied, reproduced, sold, rented, used, supplemented or otherwise used in any other way without the prior written permission of Rosenberg. Except for the rights of use and other rights expressly granted herein, no other rights are granted to the user nor shall any obligation be implied requiring the grant of further rights. Any and all patent rights and licenses are expressly excluded.

6. Hyperlinks

The Rosenberg website may contain hyperlinks to the web pages of third parties. Rosenberg shall have no liability for the contents of such web pages and does not make representations about or endorse such web pages or their contents as its own, as Rosenberg does not control the information on such web pages and is not responsible for the contents and information given thereon. The use of such web pages shall be at the sole risk of the user.

7. Liability for defects of title or quality

Insofar as any information, software or documentation is made available at no cost, any liability for defects as to quality or title of the information, software and documentation especially in relation to the correctness or absence of defects or the absence of claims or third party rights or in relation to completeness and/or fitness for purpose are excluded except for cases involving willful misconduct or fraud. The information on the Rosenberg website may contain specifications or general descriptions related to the technical possibilities of individual products which may not be available in certain cases (e.g. due to product changes). The required performance of the product shall therefore be mutually agreed in each case at the time of purchase.

8. Data Privacy Protection

Through our websites, Rosenberg will not collect any personal data about you (e.g. your name, address, telephone number or e-mail address), unless you voluntarily choose to provide us with it (e.g. by registration, catalog order), respectively, provide your consent, or unless otherwise permitted by applicable laws and regulations for the protection of your personal data. When you do provide us with personal data, we usually use it to respond to your inquiry, process your order or provide you access to specific information or offers. Also, to support our customer relationship with you we may store and process personal data and share it with our worldwide affiliates to better understand your business needs and how we can improve our products and services.

We do not sell or otherwise market your personal data to third parties, except to members of Rosenberg Group. Through your use of telecommunications services to access our website, your communications data (e.g. Internet protocol address) or utilization data (e.g. information on the beginning, end and extent of each access, and information on the tele-communications services you accessed, type of Internet browser and operating system used, domain name of the website from which you came, number of visits, average time spent on the site, pages viewed) are technically generated and could conceivably relate to personal data. We may use this data to monitor the attractiveness of our websites and improve their performance or content.

9. Privacy policy for Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). 
Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. On this website IP-anonymisation is activated. So your IP address will be truncated within the area of Member States of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. 
On behalf of the website provider Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to the website provider.

10. Severability Clause

If individual regulations of this contract should be, or should become, ineffective, this does not alter the validity of the remaining regulations within this contract. The parties commit to replace ineffective regulations in a legally permissible way, with new regulations which then restore effectiveness. The same applies to regulation omissions in the contract. To overcome such omissions, the parties commit to compile and include suitable regulations, which are consistent with the sense and purpose of the contract, and which would have been included by the parties if the point had been considered by them.
